2. William Key of Nottingham, gent (executor of will of Catherine Ashton, late of Grantham, widow, deceased, who was widow and executrix of William Ashton, late of Grantham, esq, her late husband),
3. Thomas Stanser, Alderman of the borough of Grantham, Thomas Cooke of Manthorpe in the parish of Grantham (nephew and devisee in the will of Roger Cooke, late of Manthorpe, yeoman, deceased) and Richard Gibson of Great Gonerby, tailor,
4. Samuel Forster of Grantham, gent.
Quotes mortgage of 16 Sep 1730 by Edward Coddington, gent, and William Coddington to Christian Farmer of Stamford, spinster, of property in Grantham, Manthorpe, and Gonerby; and assignment of 1 May 1735 by Christian Farmer to William Ashton, for securing £500 and interest. Recites that in 1742 Mary Alden, Adlard Stukeley and Elizabeth his wife sold parts of the mortgaged premises to various persons, and thereupon William Ashton assigned over to William Read of Grantham, maltster, the said mortgage term in trust for the several purchasers: and William Ashton at the same time agreed to accept the rest of the premises as a security for his principal and interest. Several of the title deeds of the lands so sold being also title deeds for the lands remaining as security, it was agreed that several of such deeds should remain in the custody of William Ashton for the equal benefit of all the parties. Recites that William Ashton afterwards lost one of the indentures, and the other indentures now remain in the custody of William Key. Recites that by several mesne assignments the residue of the mortgaged premises are now become vested in Samuel Forster for security of £350 and interest. William Key having received his full principal and interest is desirous of delivering up all the title deeds.
Thomas Stanser declares that he has received from William Key the release of 21 Oct 1730, and agrees with 4. that when required he will produce it is any court of law or elsewhere.
4. acknowledges the receipt from 2. of indenture of assignment of 1 May 1735, which is to go along with the rest of the title deeds delivered to 4. on his advancing the £350 on the mortgaged premises, and is to remain with 4. until the repayment of the £350 and interest.
1. and 3. consent that William Key shall no longer be accountable for the deeds, except the lost one. | Subjects: | Country Estates Church Of England Parishes Religion & Beliefs | Temporal: | 12 July 1750 | Source: | Lincolnshire County Council | Identifier: | http://www.lincstothepast.com/Records/Re... | Go to resource |
