Conditions and considerations: rehearses the other previous settlements THOR/2/4/7 and THOR/2/5/1, also rehearses lease and release by which the Duchy of Cornwall property in Grayingham had previously been settled 27 & 28 Oct 1757 and the lease and release 23 & 24 Aug 1770 relating to settlement of property in Gainsborough and Lea as in THOR/2/4/4 (or very much so) and also the property in North and South Wheatley, Nottinghamshire, messuage in the occupation of Marmaduke Nicholson, 2 closes of 10a. of meadow, pasture or arable belonging to the messuage to Sir John Thorold for life, to William Welby and Thomas ?Heron to preserve contingent remainders, to John Thorold similarly and the sons of his body, also in the same lease and release Sir John Thorold covenants to release messuages and lands in Rampton, Nottinghamshire, also lands in Normanby in Stow and Gainsborough, part freehold and part copyhold in which he is seized expectant on the death of Dame Shirecliff, widow of his father to the same uses.
Consideration that Jane Hayford is seized of the manor of Millington, Cheshire, and of other messuages and lands in the same county subject to payment of a rent charge of £400 to Jane Hayford, her mother. She is seized in reversion of the manor of Bollam, Nottinghamshire, after the death of her mother and of a capital messuage in the town of Derby, and other messuages in Derbyshire and Yorkshire. Personal estate including £10,000 due in mortgage from the Rt Hon Richard, earl of Scarborough, £5,000 3 per cent bank consols. J ane Hayford and her mother to convey the manor of Bollam in return for an annuity of £100 to the mother, which was done by indenture of even date.
A settlement of the manor of Millington and hereditaments in the town of Derby for the benefit of Jane Hayford, John Thorold and their children other than the eldest son, subject to a rent charge of £150 to the mother, also done by an indenture of even date.
A separate trust for the use of Jane Hayford of part of her personal estate and for dealing with some payments subject to the interest of Sir John Thorold and Dame Elizabeth.
New dispositions of property: Sir John Thorold and John Thorold revoke all the uses and trusts of 11 Sep 1770 (THOR/2/5/1) except the term of 500 years to Brownlow Cust and George Deligne Gregory.
They grant and appoint to Job Staunton Charlton the manor of Syston as covered by the deed of 11 Sep 1770.
The manor of Grayingham as settled by deed of 28 Apr 1757.
Brownlow Cust and George Deligne Gregory grant to Sir John Thorold and John Thorold the manor of Marston to merge the term of 500 years and the properties are to be held by Job Staunton Charlton as follows
Description of uses: Syston, Syston Park and the newly erected mansion and old capital messuage and advowson, and lands in Syston, Ringthorpe, Snitterby, Atterby, Caythorpe, Foston, and Westborough, also the manors of Sedgebrook, Newboe and messuages and lands in Sedgebrook, Newboe, Casthorpe, Barrowby, Denton, Allington, Bennington, Manthorpe and Gonerby in the occupation of persons as set out in THOR/2/5/1, with a rental of £1,284 1s. 4d. and not limited to Dame Elizabeth Thorold for life by the deed of 11 Sep 1770, to John Thorold for life and after to Brownlow Cust and Job Staunton Charlton to preserve contingent remainders. After the death of John Thorold: the Syston - Westborough group and the Sedgebrook - Gonerby group to William Welby and William Chambers for a term of 600 years to make a jointure or annual rent charge of £1,200 for Jane Hayford with provision for distraint.
Appointment of a further term of 800 years to William Welby and William Chambers in Sedgbrook - Gonerby group from the decease of John Thorold. And after these terms of 600 and 800 years to the use of the first son of John Thorold and Jane Hayford and his heirs male and for default in turn to all other sons, to the sons of John Thorold by any subsequent marriage, and for default to Sir John Thorold for life, and to Brownlow Cust and Job Staunton Charlton to preserve contingent remainders.
The other premises not yet appointed to John Thorold after marriage, to Sir John Thorold for life and to the trustees for contingent remainders.
Then after his death, as to the Sedgbrook group of £449 14s. as in THOR/2/5/1, to Dame Elizabeth and to trustees to preserve contingent remainders.
Then as to the estates limited to Sir John Thorold and Elizabeth, after the death of the survivor, to John Thorold for life and to the trustees to preserve contingent remainders.
After the death of John Thorold, as to both estates in Grayingham and as to the properties for life limited to Sir John Thorold and after the marriage, to William Welby and William Chambers for 1,000 years. And after both the estates governed by this term and by the life interest of Sir John Thorold, Dame Elizabeth and John Thorold, to the sons of John Thorold and Jane Hayford and their heirs male.
And in default as to Marston, that a rent of £300 from this may be paid to Jane Hayford if she survives, in addition to her jointure previously laid down.
Amd then as for the manor of Marston so charged for the other lands limited for life to Sir John Thorold, for those covered by the term of 1,000 years to the first and other sons in turn of John Thorold and any other woman he may marry.
And then, after the termination of the 600, 800 and 1,000 year terms, and subject to the annuities before mentioned, to the use of George Thorold, second son of Sir John Thorold for life, to the trustees for contingent remainders, to the sons in turn of George, and after that similarly of Samuel Thorold, third son for life, and to his sons, to the use successively of any other sons of Sir John Thorold and their heirs male, to the use of the heirs of the body of John Thorold, George, Samuel, and Sir John Thorold, and in default to John Thorold and his heirs forever.
The 600 year term is for the trustees, William Welby and William Chambers, to make provision of £10,000 to be raised for the younger children of John Thorold and Jane Hayford.
The 800 year term is for the better securing of the £1,200 to Jane Hayford.
The 1,000 year term for a further £10,000 to be raised for portions for children in certain contingencies (long and detailed instructions).
