Description: | John Thorold of Cranwell, bart., John Thorold, esq., son and heir of the first part,
William Welby of Denton, esq. and John King of Ashby de la Laund, esq. of the second part,
Christopher Nevile the elder of the Close of Lincoln, esq. and Coningsby Sibthorpe of Canwick, esq. of the third part,
Brownlow Gust of Belton, bart., and George Deligne Gregory of Harlaxton, esq. of the fourth part.
Property: as in THOR/2/4/5 above with modifications as below.
Conditions: the terms of THOR/2/4/7 are recited, after which it is stated that only the term of 200 years in the manor of Syston etc. as there set forth to Francis Fane and Samuel Forster, their executors and assigns, and the uses of that, are to stand, and after that, concerning all the other properties to Sir John Thorold and John Thorold for life or until John Thorold shall marry, and then, and then, after marriage, as to the manor of Syston, and the park with the newly erected capital messuage or mansion house, the old capital messuage or manor house, the advowson and the messuages, farms, etc. in Syston, Ringthorpe, Snitterby, Atterby, Caythorpe, Foston, Westborough, and the manors of Sedgebrook, Newboe, Casthorpe, the manor house of Sedgebrook, the capital messuage of Newboe, and lands etc. in Sedgebrook, Casthorpe, Newbo, Barrowby, Denton, Allington, Bennington, Manthorpe and Gonerby, now or late in the tenure of Mr. William Leeson, Edward Leeson, William Bayne, Benjamin Wade, William Turney, John Hollingworth, William Newcome, Robert Collingwood, widow Allen, John Robinson, Joseph Hardy, Thomas Leeson, Thomas Williams, Thomas Howett, William Twelch, John Stennett, Samuel Sanders, William Leeson, Thomas Read, widow Chester, John Goy, John Richardson, Thomas Dennis, John Welborne, Thomas Jackson, and William Palin, the rents amounting to £1232: 8s. from premises in Sedgbrook, Barrowby and Casthorpe not being limited to Dame Eliz. Thorold for life.
To the use of John Thorold for life, to the use of William Welby and John King to preserve the contingent remainders, to the use of the first son and his heirs male up to the 8th and every other son then, if Sir John Thorold is living at the time of John Thorold's death, for him for life.
As for the manor of Marston etc. (after the marriage of John Thorold) to the use of Christopher Nevile and Coningsby Sibthorpe for 60 years (see below).
And after this term, and for all other premises not yet limited, to Sir John Thorold for life, after his death, as far as the 2 messuages in Sedgebrook, Casthorpe and Barrowby to the yearly value of £499: 14s. to the use of Dame Eliz. wife of Sir John Thorold for jointure.
As to the manor of Marston, and lands in Sedgebrook, Newbo, Casthorpe, Barrowby, Denton, Allington, Bennington, Manthorpe and Gonerby not limited in use, to John Thorold for life, immediately after the death of Sir John Thorold except the 2 messuages etc. limited to Dame Elizabeth.
And as for the 2 messuages etc. after the death of the survivor Sir John Thorold or Dame Eliz., to the use of Sir Brownlow Cust and George de Ligne Gregory for a term of 500 years (see below). Any further properties not yet limited by this deed to the use of John Thorold, to William Welby and John King for contingent remainders, to the use of sons up to the 8th and any more of the body of John Thorold and heirs male.
In default of such issue, the whole of the property with the new house at Syston Park to George Thorold for life, to William Welby and John King to preserve contingent remainders, to the use of the sons of the body of George Thorold up to the 8th, to Samuel Thorold in default of this, to the trustees to preserve contingent remainders, to the sons of Samuel Thorold as before, then to any other sons of Sir John Thorold and their heirs male, then to the daughters of John Thorold, of George Thorold and Samuel Thorold successively, for default to the heirs of the body of John Thorold's first and other sons, for default to any daughter of Sir John Thorold, to the heirs of Sir John Thorold forever.
The term of 60 years of Christopher Nevile and Coningsby Sibthorpe in the manor of Marston for maintenance for the younger children of John Thorold if he died before his father and until their portions are paid.
The term of 500 years of Sir Brownlow Cust and George de Ligne Gregory to raise £10,000 for portions for any younger children of John Thorold. Power to appoint jointures, warranty of £1500 to John Thorold, George for £500, Samuel for £500, as and if they succeed, the sum being raised to not more than £1000 if money is not being paid out for John Thorold's wife.
Power to make leases of 21 years.
Power to revoke these trusts if circumstances alter except the 500 year term.
