Description: | Charles, Lord Clifford, Baron Clifford of Chudleigh.
To wife, Eleanora, Lady Clifford, his leasehold house and premises, 8 Mansfield Street in the parish of Marylebone, for his term in the same with all the fixtures and effects which shall be there and in his house at Irnham, with such plate there and elsewhere marked with her cypher E.C., and all her paraphernalia and all such ornaments, jewels, and trinkets as he may have given to her, and all his coaches and carriages of every kind, together with the horses and harness used with the same, and £500, and all arrears of rent which shall be due at the testator's death from the tenants of the Irnham estate.
To William, Lord Stourton, the family plate, the diamond earrings left his wife by her mother, the diamond ring given by Queen Catherine to the Lord Treasurer Clifford, the bed worked by the Duchess of Norfolk, the paintings at Ugbrook, the gilt basin and the pieces of plate given him by the Subscribers to the internal defence of the County of Devon and by the Volunteer Officers of the County, on trust to allow them to remain to the possessors of his settled estates in Devon as heirlooms. His wife to be at liberty to wear the earrings during her life.
By virtue of his marriage settlement, he has power to appoint £2000 among his younger children secured on the Hummingham estate, Warws. Appoints £500 to his daughter the Hon. Louisa Clifford, £500 to his son the Hon. Robert Clifford, £100 each to his sons Charles Edward and Walter, £250 each to his daughters Eliza and Appollonia, and £100 each to his daughters Christina and Mary. By his marriage settlement he is also empowered to appoint among his children £10000 charged on the Irnham estate, payable after the death of his wife and himself. Recites that on the marriage of his daughter Christina with Humphrey Weld esq., he advanced £4000 as part of her fortune, and the Dowager Lady Arundell gave a bond to secure to her an additional £2000, and that on the marriage of his daughter Charlotte with the Hon. Charles Langdale he secured £4000 and executed a bond for securing £2000 to be paid after the deaths of the survivor of Lady Clifford and himself. On the marriage of his daughter Mary Lucy with the Hon. Mr. Stourton, he paid down £4000 and executed an appointment to her of a further £4000. Now, in further exercise of the said power, he appoints that £2000 shall be paid for the benefit of his daughter Christine. Declares that it shall be taken in discharge of the bond of £2000. Appoints that £2000 be paid in satisfaction of the bond which he executed for the benefit of his daughter Charlotte on her marriage with Charles Langdale. Appoints £1400 for the benefit of his daughter Louisa. Appoints to his daughters Eliza and Appollonia and to his sons Charles, Edward, Walter, and Robert £100 each, their shares of the £10,000.
Recites that by a bargain and sale of 24 July 1811 and by the settlement on the marriage of his eldest son, dated 5 Aug 1818, he has power to charge £10000 with interest upon his settled estates in Devon. Having already exercised the power to the extent of £7279, now he charges the property with the payment of £2721, the residue of the sum of £10000, from the time of his death. For raising this sum, he appoints the property to William, Lord Stourton, for 1000 years from the day of his death, on trust to raise this sum as part of his personal estate and to pay it to his executor. Directs that £4000 shall be applied out of his personal estate in discharge of the £4000 settled by him on the marriage of his daughter Christina. Gives to his son Robert £3500 and interest at 5 per cent from the day his decease. Gives to his daughter Louisa £3600 and interest at 5 per cent from the day of his decease. Directs that his son Robert and his daughter Louisa shall not call upon his executor for the payment of the principal of their legacies until four years after his death, and requests that his daughter Christina and her trustees will do likewise. To his sons Charles, Edward, and Walter, and to his daughter Louisa £100 each, and to his daughters Eliza and Appollonia £750 each, and to his daughters Christina Weld and Lucy Stourton £100 each for their separate use. To his son Edward an annuity for life of £100, to begin at the testator's decease. To his son Walter a similar annuity of £100. To his daughters Appollonia and Eliza annuities of £25 each.
Ratifies an annuity of £35 bequeathed by his late brother Hugh, Lord Clifford, to Nicholas Chavarock for his life, an annuity of £40 bequeathed by his late brother to Mary Ball, who married Peralli, and an annuity of £20 paid by the testator to Abbe Vauquelin for his life.
Bequeaths the residue of his personal estate to his eldest son, the Hon. Hugh Charles Clifford, if he shall be living at the time of the testator's death, but if he shall be dead, then to such of his sons or grandsons who shall upon his death become entitled to his family estates and title. Appoints his eldest son as his executor. Directs him to pay all his debts, but exonerates his personal estate from the payment of sums secured on mortgage of his real estates.
Devises all his manors, lordships, messuages, lands etc., except trust estates to William, Lord Stourton, to the uses and trusts subject to which the bulk of his settled family estates in Devonshire shall stand settled at the time of his death. Authorises the trustees for sale mentioned in the settlement with the consent of the person entitled to the actual possession to sell any part of the estates and apply the proceeds in discharge of any incumbrances affecting the family estates in Devonshire.
Gives all estates vested in him upon any trusts or by way of mortgage to his son Hugh Charles Clifford upon the same trust as are now vested in him.
