Property: a term of 500 years said to relate to Redbourne and all the Lincolnshire estates in an endorsement on the deed.
Consideration : recital of a deed 25 February 1768 between the Reverend Robert Carter of Redbourne clerk, Charlotte Carter his wife, Edward Nelthorpe of Scawby Esq. and the Reverend Richard Branston of Redbourne, which in its turn recited the will of Thomas Carter dated 22 April 1768 devising all his manors and lands to Robert Carter his brother for life, after his death to his sons in turn by survivorship and in default of sons of Robert to his brother Roger for life and to his sons in turn and in default of issue male to daughters of Robert and Roger, powers to both brothers to appoint a jointure of £600, powers for charging the estate for younger sons and daughters, a term of 500 years to Nelthorpe and Branston for raising money for younger children and £200 a year to his wife Charlotte from the death of Robert Carter, (see for this will RED/3/1/2) relates the death of Robert's wife Charlotte in her husband's lifetime and also of Roger, that Robert took the additional name of Thelwall, and died in 1787 leaving an only daughter, the term of 500 years had never been required but not surrendered, the fee simple and inheritance of the estates had by "divers acts and assurances in the law" become vested in William duke of St.Albans, Richard Branston had died in 1781, Edward Nelthorpe in 1788 leaving John Nelthorpe bart. his executor, John Nelthorpe died 1799 leaving Henry Nelthorpe bart. his executor; it was now desired to transfer the remainder of the term in trust to Thomas Nettleshipp for the duke of St.Albans.
